When my small family retail business was doing it tough after COVID lockdowns and a slew of profound personal challenges, I attempted to negotiate debt settlement with my credit provider Trucap (Bizfund Pty Ltd) via an authorised third party debt negotiator. Trucap flatly ignored this attempt to work something out and handed the account straight to Slater Byrne, who 5 days after the last repayment issued me with a warning for a default listing.

Fast forward 32 days, and they listed the default while ignoring reasonable negotiation via my representative Chapter Two, and were instead more interested in fast-tracking a default listing rather than work things out. A settlement was eventually made 4 months later for very close to the original total debt cost, although I was unaware the default had actually been listed.

The main thing is there was no attempt to negotiate a settlement prior to the default being listed, plus the default was listed less than 30 days after the initial letter (dated 08/06/22 and default listed 05/0722), and less than 14 days after the final letter. Even on their website they quote Privacy Act timeframes for consumer lending as if they follow the same reasonable guidelines for commercial, but seems no compassion or reasonable negotiation is an option for my creditor Trucap, or for Slater Byrne. This is extremely misleading.

Another point is the amount I owed was $11,810.87, however Slater Byrne were claiming $16,810.87. The $5000 difference being Slater Byrne’s commission, so instead of negotiating a customer that was doing it tough and genuinely wanted to work something out, I was charged more money!

PS I didn’t know about the default until I checked my credit file back in July this year as I was not notified of the listing being placed, and it was still listed as outstanding even though it had been settled and closed 10 months prior! Also of particular note – Slater Byrne are not a member of AFCA (Australian Financial Complaints Authority) so they ignore any dialogue complaining about the lack of compassion for mitigating circumstances.

RESPONSE TO SLATER BYRNE: that is not correct: my representative was the one attempting to negotiate, so you and Trucap ignored this. We have all emails and correspondence to back this up and have taken a screenshot of what you have written here for further legal action. There are also other in correct facts in your reply which only serve to highlight your shady tactics.
